Censorship vs Creative Freedom: Regulating Content on OTT Platforms in the Digital Age

The rise of Over-The-Top (OTT) platforms has seen a transformation of content creation and delivery which in turn has broken traditional censorship models. While these platforms report greater creative freedom and a wide range of narratives, they also present issues of obscenity, hate speech, and national security. This paper looks at the play between censorship and creative freedom in the OTT environment which we study via regulatory approaches, stakeholder points of view, and key controversies. We put a spotlight on India’s developing legal position and also make international comparisons, we put forth a put forth a balanced regulatory model which respects free expression, but also addresses social and ethical issues.
